The Alternative dispute resolution mechanism (ADR) has existed in Puntland for a long time and has been developed recently by the Ministry of Justice in collaboration with international partners. These systems regulate some of the most fundamental issues in communities, such as access to land, water, natural resources, and family relations. Unlike formal justice systems, customary justice mechanisms are more accessible and closer to the people, as they operate within communities. They emphasize restorative justice, flexible rules, and community-based solutions. As a result, they are considered more geographically accessible, culturally relevant, and inclusive. This makes them particularly important for vulnerable groups, such as women, children, and persons with disabilities, who often face barriers in accessing formal justice.

Enhancing access to Justice calls for improved capacity of its manpower including the traditional committees, religious scholars and promoting the collaboration between the formal courts and ADR mechanism in case referral, case management and execution of orders.  This initiative will address the skills and knowledge gap of the ADR practioneers and enhancing smooth collaboration between the formal courts and ADR thus reducing case load at courts and facilitating easy referral mechanism within the two systems.

Enhanced public trust in the justice system through improved efficiency of the ADR mechanism and strengthened collaboration between ADR and formal courts, leading to effective case referral and management that reducing case backlog.

  • About the Consultancy

The Ministry of Justice, constitution religious affairs and rehabilitation is planning to conduct training for ADR adjudicators in Garowe. The Ministry would like a consulting firm to develop training manual and conduct training sessions in Garowe.

  • Purpose of the consultancy assignment

The main purpose of the assignment is to develop comprehensive Alternative Dispute Resolution manual training and facilitate training sessions in Garowe.

  • Scope of work for the consultancy assignment

The assignment entails development of a comprehensive training manual and facilitation of training sessions

  • Develop comprehensive ADR training manual covering key principles of ADR
  • Translate the training manual summary into Somalia and develop power point presentation using the Somali translation service.
  • Facilitate 3 days practical training using mixed approach with adult learning approach in Garowe, Qardho, Dhahar and Badhan
  • Facilitate Quarterly coordination sessions in Garowe, Qardho, Dhahar and Badhan
  • Develop simplified agreed case referral protocol from the existing standard operating procedure of the ADR to support referral protocol and case recording

The consultancy work will undertake from October 2025 to January 2026

  • Qualification and experience of law firms/ individual consultants

The Ministry of Justice, constitution, religious affairs and rehabilitation would like experienced law firms who meet the following qualifications to submit technical and financial proposal.

  • Registered law firms with the Ministry of Justice.
  • Minimum experience 5 years’ experience in the legal fraternity and service provision.
  • Proof of past experience of similar assignments
  • Qualified and experience legal experts with minimum of 3-year experience in the legal field.
  • Lead consultant shall have master’s degree in Law (LLM) or LLB with at least 10 years’ experience
